Based on the definition of a "blighted area" it was found that, "most of the buildings fell under the Municipal Code definition of blight.  Of the 1940 buildings found within the study area, 1858, or 96% were observed to be blighted" (CCPC, 1). 


The blightedness of the area provided a legal basis for the development of the plan.  "Chapter 725 of the Cincinnati Municipal code ("Urban Renewal") authorizes the City to expend funds to eliminate blighted, deteriorating, and deteriorated areas and - toward this end - to acquire property…" (CCPC, 1).


The theoretical plan for the area "sets out to afford maximum opportunity consistent with the sound needs of the locality as a whole for the redevelopment or rehabilitation of the project area by private enterprise" (CCPC, 6).
